The 6th Amendment guarantees the right to “counsel.” The drafters of the constitution used this wording deliberately. Included in the right to counsel is the right to counsel of choice. The common law of England made it an inalienable right to have a “friend” act as counsel. Reference to common law is mandatory in a proper interpretation of the Constitution, but most particularly in the Bill of Rights. Nowhere in the constitution does it restrict citizen’s choice of counsel to licensed attorneys.

The public has an inalienable right under common law to be represented by a “friend” rather than a licensed attorney. This right is not subject to revision by the American Bar Association. The fact that attorneys have been able to maintain a self-serving monopoly on the practice of law does not make it right, nor does it make it constitutional. It is an unconstitutional abuse of power for the judiciary to force defendants to be represented by officers of the Court.

Attorneys through bar associations are doing everything they can to protect their monopoly on the practice of law. This self-serving franchise deprives citizens of the right to contract with the counsel of their own choosing. Instead, citizens are forced to accept attorney-promoted regulations created for the purpose price fixing. In a free market, licensed attorneys should have to compete against the services of laymen.

Due to advances in technology such as the internet and legal search engines like Westlaw LexisNexis, the legal profession is becoming obsolete. Instead of paying an attorney $500 an hour, everyday citizens now have the ability to research the law for themselves.

The “license” to represent a client should come from the individual, not the government. Since laypersons already have the right to represent themselves in court, it only makes sense that they should be allowed to transfer that right to anyone who the client thinks would best represent his or her interests in a court of law.

Bar associations are not governmental bodies. They are corporations. Their influence over the judiciary is undemocratic. I am proposing a demonstration to end the corporate monopoly over our legal system in support of the right to counsel of choice.


I do not live in the Chicago area. I would like someone to present this proposal on my behalf.

So what are the rules about presenting proposals? Do I have to physically come to Chicago ahead of time?

I just flew in from Dallas to present this proposal. I will be at the GA meeting tonight.
