Judicial Process Presentation

1. Anybody who engages in a violent act, including assault or battery, against another person at an Occupy Chicago event or facility shall be banned indefinitely from all Occupy Chicago events and facilities.

2. Anybody who steals or intentionally damages the property of Occupy Chicago or any of its members shall be banned indefinitely from all Occupy Chicago events and facilities.

3. All decisions relating to violations of rules by individuals or disputes between individuals within the movement that would otherwise be brought before the GA shall instead be brought before a specially-scheduled judicial GA.  The judicial GA is a GA and shall have all the same procedures and powers thereof, except that it shall hear judicial matters as designated by the GA.

4. Before being brought to the GA, any violations of rules by individuals or disputes between individuals shall be subject to a hearing by the judicial advisory committee.  The judicial advisory committee shall appoint a panel made  of three people for this purpose who shall as their charge resolve conflicts, adjudicate violations of the rules, and other duties as designated by the GA.  The panel shall serve for a term of one month and shall be chosen at random from volunteers within the judicial advisory committee, subject to a veto by a single member in an anonymous poll taken for that purpose.  All decisions of the panel must be unanimous and are subject to being overridden by a simple majority of the GA (or judicial GA, if #3 has passed).

Internal Affairs Evaluation Process (name change)

Anyone who is involved in a physical or verbal confrontation, physical or verbal intimidation, sexual harassment, theft, or involved in any situation that violates Occupy Chicago rules will be subject to the procedure of Internal Affairs Evaluation.

The creation of an internal affairs evaluation committee will be created consisting of members who tasks include skills used in but not limited to conflict resolution, safety and security, and space management. This committee will be open to anyone to join.

Once a month a fact finding panel will be formed by random selection of the internal affairs evaluation committee. The panel will consist of no less than 3 members, and no more than 5 members. Every member must serve on the panel before being selected again. The purpose of the panel is to gather information about the situation, record personal statements, and receive input on the preferred method of resolution according to the parties involved.

Once the situation has been made aware of, the parties involved will submit personal statements to the fact finding panel. Each of the parties will give input on their preferred method of resolution. The panel holds the right to overturn the preferred method of resolution if the preferred method violates Occupy Chicago rules. Each party will be suspended from Occupy Chicago for one week so that the internal affairs evaluation committee can peacefully and comfortably discuss and contemplate the information presented to them.

Once the preferred method of resolution is identified the internal affairs committee will confer on the measures to take to address the problem and bring the situation to a successful resolution. The measures taken may include but are not limited to peace circles, a non-voting GA, etc.

If someone's membership is in question the matter will be brought to a non-voting GA on Thursday at 5pm. All information mentioned must be collected by the internal affairs evaluation committee before a non-voting GA takes place so that participants may be properly informed.

The internal affairs evaluation committee will decide the non-voting GA structure, and voting procedures.

Special Circumstances
Each situation will be assigned a fact finding panel from the members of the internal affairs evaluation committee. In the event that the evaluation process caries over from one month to another, the same panel will work on their assigned situation, but a new panel will be selected for and situations occurring in that month

In the event that there are multiple situation occurring in the same month. If there are enough members to choose from, from the internal affairs evaluation committee then a separate panel will be assigned for each situation.

In the event that there are multiple situations occurring in one week then an additional non-voting GA at a different time will be scheduled if necessary for each additional occurrence.

leaving the structure of the non-voting GA out in the open is almost definitely going to create problems.

How is this not setting up an inquisition? I thought we were against hierarchy, but we're talking about creating a body that can punish people.

Also, I don't see the feasibility of enforcing a ban from events. Most of our events are in public and unpermitted. What right do we have to tell anyone they can't be in public when and where they want to be?
