As Congress considers vastly expanding the power of copyright holders to shut down fair use of their intellectual property, this is a good time to remember the other activities that Obama’s “regulatory czar” Cass Sunstein wants to shut down using the tools of copyright protection. For a couple of years now, Sunstein has been advocating that the “notice and take down”* model from copyright law should be used against rumors and conspiracy theories, “to achieve the optimal chilling effect.”*

Answer:  The Office of Information and Regulatory Affairs (OIRA) is a Federal office part of the Office of Management and Budget, which is an agency within the Executive Office of the President. In addition to reviewing collections of information under the Paperwork Reduction Act, OIRA reviews draft regulations under Executive Order 12866 and develops and oversees the implementation of government-wide policies in the areas of information technology, information policy, privacy, and statistical policy. OIRA also oversees agency implementation of the Information Quality Law, including the peer review practices of agencies.

(Disclaimer: I am not a Glenn Beck fan. I disagree with him tremendously on his conservative agenda. That said, he from time to time shows growth in his awareness of issues.  FOX gave him the shaft when he wouldn't walk lock and step.  I only posted the above video because he mentions Cass Sunstein and Freedoms of the Internet.  Again, I apologize for any offense.)

Do we know any specific and detrimental legislation he's supported? Just curious.

Ah, there's the genius of his appointed position. He's like an "internal lobbyist" as is the committee he is in charge of. He advises as well as publishes books on the agenda.

OIRA’s Review of Agency Regulations
What is the OIRA’s role in the rulemaking process?

Answer: Executive Order 12866 describes OIRA’s role in the rulemaking process. In it, the President directs agencies, to the extent permitted by law, to follow certain principles in rulemaking. These principles include consideration of alternatives to the rulemaking and analysis of the rule’s effects on society, both its benefits and costs. As the Executive Order directs, OIRA reviews agency draft regulations before publication to ensure agency compliance with this Executive Order.

CASS SUNSTEING has said to “enlist nongovernmental officials in the effort to rebut the theories. It might ensure that credible independent experts offer the rebuttal, rather than government officials themselves. There is a tradeoff between credibility and control, however. The price of credibility is that government cannot be seen to control the independent experts.”

Sunstein “wants to hold blogs and web hosting services accountable for the remarks of commenters on websites while altering libel laws to make it easier to sue for spreading ‘rumors,’” wrote Ed Lasky at American Thinker.
